Terms of Service
Last updated: Sep 1, 2026
These Terms of Service govern access to the GroundVue website at groundvue.org, the authenticated GroundVue application, GroundVue data products and exports, GroundVue APIs, and related services (collectively, the “Services”). GroundVue Public Benefit Corporation (“GroundVue”) is a Colorado public benefit corporation. By using a Service, you agree to these Terms. If you do not agree, do not use the Services.
A separate order form, subscription agreement, or other written agreement may apply to a paid or organizational account. If that agreement conflicts with these Terms, the separate agreement controls for that account.
Accounts and access
You must provide accurate account information and keep it current. You are responsible for protecting your credentials and for activity performed through your account. Notify GroundVue promptly at info@groundvue.org if you believe an account has been accessed without authorization.
You may use GroundVue only if you can legally enter into these Terms. If you use GroundVue for an organization, you represent that you are authorized to accept these Terms for that organization.
Using GroundVue
Subject to these Terms and any agreement governing your account, GroundVue permits you to access and use its services for lawful personal, professional, or internal organizational purposes.
Your account, plan, or customer agreement may establish access, export, API, or usage limits. You may use downloads and exports that GroundVue makes available to you for lawful internal purposes, subject to those limits and any separate agreement.
You may not:
- Use GroundVue in violation of applicable law or another person's rights.
- Misrepresent your identity or affiliation, impersonate another person or organization, share credentials outside the users authorized for an account, or use an account without authorization.
- Send spam or other unauthorized promotional material through a GroundVue service.
- Attempt to bypass access controls, obtain another user's credentials, or gain unauthorized access to a system, account, server, or database.
- Introduce malicious code, reverse engineer a Service except where that restriction is prohibited by law, conduct a denial-of-service attack, or interfere with the security, availability, or proper operation of a Service.
- Use automated or manual means to scrape, copy, or monitor GroundVue created content at scale outside the exports, APIs, or other access GroundVue has authorized.
- Resell or republish a GroundVue created dataset, taxonomy, summary, or analysis outside rights granted by your plan or customer agreement.
- Use personal information obtained through GroundVue for unlawful surveillance, harassment, discrimination, or another unlawful purpose.
- Remove source, provenance, or ownership notices, or represent GroundVue created analysis as an official government record.
- Use GroundVue in a manner that unreasonably burdens the service or prevents another person from using it.
Public records and GroundVue materials
GroundVue works with public meeting recordings, government records, and other source material that may be owned by a government body, a third party, or the public. These Terms do not give GroundVue ownership of material it does not otherwise own.
GroundVue owns or licenses the platform, software, design, branding, data organization, original writing, classifications, summaries, and other materials it creates, subject to any rights in the underlying source material. GroundVue and its licensors reserve all rights not expressly granted in these Terms.
Paid services
Some GroundVue services may require payment. Prices, billing frequency, renewal terms, and any cancellation or refund terms will be presented when you purchase a service or in the agreement governing your account. You authorize the applicable payment provider to process the payment information you submit.
Third party services
GroundVue may rely on or link to services operated by other organizations, including government source systems. GroundVue does not control third party services and is not responsible for their content, availability, security, or privacy practices. A link or integration does not by itself imply endorsement.
SMS messages
If you opt in to text messages from GroundVue, GroundVue may send conversational and informational messages, including appointment reminders and responses to your inquiries. Message frequency varies. Message and data rates may apply.
Reply STOP to opt out or HELP for help. You may also contact info@groundvue.org. Agreeing to receive GroundVue messages does not authorize another company to send you messages.
The Privacy Policy explains how GroundVue handles information associated with SMS communications.
Suspension and termination
GroundVue may limit, suspend, or terminate access when reasonably necessary to protect the service or its users, respond to a legal requirement, address nonpayment, or enforce these Terms. You may stop using GroundVue at any time. Terms that by their nature should continue after access ends, including provisions concerning ownership, disclaimers, liability, and disputes, will survive.
Intellectual property concerns
If you believe material available through GroundVue infringes your intellectual property rights, send a notice to info@groundvue.org that includes:
- Your physical or electronic signature, or the signature of a person authorized to act for the rights holder.
- Identification of the work or right you believe has been infringed.
- Identification and location of the material you want GroundVue to review.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the rights holder, its agent, or the law.
Notices may also be mailed to GroundVue Support, 712 H Street NE, Suite 1383, Washington, DC 20002, United States. GroundVue may request additional information needed to evaluate an incomplete notice.
Service availability and warranties
GroundVue may change, interrupt, or discontinue part of a service. Public source information and automated analysis may be delayed, incomplete, or inaccurate.
TO THE FULLEST EXTENT PERMITTED BY LAW, GROUNDVUE PROVIDES ITS SERVICES “AS IS” AND “AS AVAILABLE” AND DISCLAIMS EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GROUNDVUE AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO A SERVICE.
TO THE FULLEST EXTENT PERMITTED BY LAW, GROUNDVUE'S TOTAL LIABILITY ARISING FROM OR RELATED TO A SERVICE WILL NOT EXCEED THE FEES GROUNDVUE RECEIVED FROM YOU FOR THAT SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limitations apply regardless of the legal theory asserted and even if GroundVue was advised that damages were possible. They do not exclude liability that cannot lawfully be excluded or limited.
Governing law and disputes
District of Columbia law governs these Terms without regard to conflict-of-law principles.
A dispute arising from or related to these Terms must be brought in a court of competent jurisdiction in the District of Columbia. If a provision of these Terms is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver.
YOU AND GROUNDVUE MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS OR REPRESENTATIVE ACTION.
Changes and questions
GroundVue may update these Terms as its Services change. The date above identifies the latest revision. Updated Terms apply when posted unless a later date is stated. GroundVue will provide any additional notice required by law or an applicable customer agreement.
Questions about these Terms may be sent to info@groundvue.org.
